Advance pricing agreement

An advance pricing agreement, or APA, is a formal agreement between a taxpayer and one or more tax authorities that fixes the transfer pricing method for specified intercompany transactions in advance, giving the group certainty over its position for a set number of years rather than defending it retrospectively during an audit.

APAs can be unilateral, involving just one tax authority, or bilateral and multilateral, involving two or more authorities who agree the same position jointly, and bilateral APAs are generally preferred where double taxation risk is high, since they remove the risk of two countries taxing the same profit differently.

The process is lengthy, often taking one to three years from application to agreement, and requires detailed functional and financial analysis upfront, so APAs tend to be reserved for high-value, high-risk or recurring transactions where the cost of the process is justified by the certainty it delivers.
